Renewal, Inactivity and Termination of an IR Position

13.1 IR Renewal

    The renewal fee is due annually 30 days before the anniversary of the original sign-up date to maintain the active IR position. This fee is currently $50. Failure to renew the fee within 30 days will result in termination of the IR’s status.

    The IR’s customers and downline will be compressed as described above

13.2 Renewal in the first 6 months after Cancellation

    If the IR position has been cancelled for failure to pay the renewal fee and the IR chooses to reactivate within 6 months or less from the renewal date, the IR may pay the appropriate renewal fee and reactivate their original position under their original sponsor. The IR does not have an option of starting a new individual position or of participating through an interest in a partnership or corporation. Unpaid commissions and fees that would have been paid during this time are not paid retroactively.

13.3 Renewals after 6 months

    MapleLeaf CA will require that they start a new position, and will not allow them to reactivate their former position.  If an IR wants to start up under a different sponsor, MapleLeaf CA will allow it. In either case. this will be a new position and will require new customers and new reps.

13.4 Voluntary Termination of Independent Representative Status

    The IR agreement may be terminated at any time for any reason by submitting a personally signed letter stating his/her decision to terminate to MapleLeaf CA Customer Relations, 100, Boul. Alexis-Nihon, Bureau 283, St. Laurent PQ H4M 2N7

    The termination will become effective on receipt by MapleLeaf CA The IR, having terminated his/her position may re-apply after 6 (six) months from the effective date of termination, or renew within a 6(six) month period after a voluntary termination

13.5 Involuntary Forfeiture or Termination of Independent Representative Status

  1. At the sole discretion of MapleLeaf CA , the company may impose forfeiture of commissions and bonuses or terminate the IR Agreement and the OR business relationship with MapleLeaf CA for policy breach or other cause including but not limited to the following reasons:
  2. Slamming, cramming, spamming or misrepresentation of any aspect of the MapleLeaf CA service or product or the MapleLeaf CA Business Opportunity being offered to a customer or prospective IR
  3. Failure to renew the IR’s agreement to active status at the end of the year’s term.
  4. Breach or violation by the IR of any term or provision of MapleLeaf CA ’s Policies and Procedures.
  5. Failure of the IR to earn a commission or bonus cheque for a period of 12 consecutive months
  6. The IR disparages or discredits the name of MapleLeaf CA
  7. The IR cross-recruits, recruits on behalf of a competitor of MapleLeaf CA or otherwise engages in an activity that constitutes a conflict of interest.
  8. The IR misrepresents MapleLeaf CA or the MapleLeaf Opportunity in any manner including making claims contrary to MapleLeaf CA material
  9. Breach of industry codes or business ethics including MapleLeaf CA Code of Conduct or the Direct Selling Code of Conduct
  10. Any other material cause at the sole discretion of MapleLeaf CA
  11. In the instance of forfeiture of commission or terminations, MapleLeaf CA will inform the IR in writing, effective of the date of the written communication. 

    The IR will have ten (10) days from the date of mailing to respond and appeal in writing. The written appeal must be received or postmarked within ten (10) days of the first letter. If the appeal is not received within the time limit, it will be considered that the forfeiture/termination is accepted.

    If a timely appeal is filed, MapleLeaf CA will review and consider any further appropriate information, and notify the IR of their decision. The decision will be final.

    If it is not rescinded the forfeiture/termination will be effective as of the date of the original notice.

    In order to protect itself, it’s IRs and its customers, MapleLeaf CA may suspend the IR’s access to information on the website and any commission or bonus deposits until the matter has been resolved

13.6 Termination for Violation of MapleLeaf CA Policy and Procedures

    If an IR’s position is terminated or cancelled for a violation of any of the MapleLeaf CA Policies and Procedures, the MapleLeaf CA may at its discretion decide that the IR never be allowed to reactivate his/her position or start a new one with MapleLeaf CA

13.7 Effect of Termination

    All commissions and other payments will cease as of the effective date of termination, whether voluntary or not.
