Prohibited practices and activities
7.1 Conflict of interest
An IR whose employment or other affiliations allow access to accounts or SINs are prohibited from using this information to further their MapleLeaf CA IR business. Such activity is a breach of these Policies and Procedures.
7.2 Phantom Positions
An IR shall not sign up an IR position on behalf of another individual, nor give an invalid or false SIN or other registration numbers. Forgery of another individual’s name or establishing phantom IR positions will subject an IR to termination penalties, including fraud.
7.3 Tampering
No employee or IR of the company has the authority to agree to any modification, alteration or any other change to these Policies and Procedures without the specific approval of the corporate office.
The alteration of any information such as an IR’s ID number or signing of a contract by anyone other then the individual entering into that contract is strictly prohibited.
7.4 Unauthorized Contact
- Independent Representatives are not permitted to communicate with third parties (vendors, suppliers, etc…) that are engaged in business activities with MapleLeaf CA All business communications, with third parties, will be conducted by the company. IRs may face consequences that could result in, but are not limited to, legal action or forfeiture of commissions, or termination of the association with the company.
7.5 Cross Recruiting
- The solicitation of MapleLeaf CA. Independent Representative to become representatives of other companies is strictly prohibited. This is cross-recruiting. The use of MapleLeaf CA facilities, membership lists, the upline-downline e-mail system and MapleLeaf CA correspondence to promote other companies may result in, but is not limited to, legal action, forfeiture of commissions, or or termination of the association with the company
7.6 Slamming and Cramming
MapleLeaf CA IRs may under no circumstances convert or sign up new customers or MapleLeaf CA IRs without their authorization. (Slamming)
They may not add, change or remove the services of existing customers without their authorization. (Cramming)
Both these practices are strictly prohibited, and will immediately result in the responsible MapleLeaf CA Associate’s immediate termination and forfeiture of all commissions and other payments. Non-compliance to this policy is contrary to law and may constitute fraud.
MapleLeaf CA may refer MapleLeaf CA IRs who transgress this policy to the appropriate regulatory and/or government agencies. In the course of such referrals, MapleLeaf CA will provide such regulatory and/or government agencies with personal information relating to the Independent Representative and such other information or assistance as required by MapleLeaf CA or bylaw.
7.7 Spamming (Bulk E-mails)
MapleLeaf CA IRs are prohibited from utilizing unsolicited bulk email distributions known as spamming to unrelated or off topic groups or any other email distributions to solicit in any manner or for any purpose prospective MapleLeaf CA customers IRs. This includes emails that contain unauthorized use of copyrighted material or trademarked materials, threatening or obscene materials or materials protected by trade secrets.
Fraudulent behaviour including but not limited to the forging of forum postings or electronic mail, unauthorized use of a third party’s Internet domain name or otherwise misrepresenting a message’s point of origin is forbidden. Harassing or abusing others through email or forums is prohibited, as are rude, vulgar, sexually explicit or inferential language or symbols. The promotion of chain letters or any pyramid or endless chain is strictly prohibited.
In addition to damages or penalties provided by in the law, violation of this may subject the IR to termination of his/her position.
7.8 Door-to-door Solicitation Prohibited
Due to various licensing requirements across the county, MapleLeaf CA prohibits door-to-door selling of our products and services. Prospecting and customer gathering should be targeted at your friends and family and we encourage you to continue to prospect in your warm market and ask for referrals.
7.9 Purchase and sale of customers
No IR may purchase, sell or give a customer to or from any other person or IR position.
IRs will be held responsible for any customer provided to them through compression (see Compression)
